How long does Maclear store transaction records and personal data?

Maclear retains transaction records and personal data for a minimum of 10 years following account closure, as required by Swiss AML legislation and set out in the General Terms & Conditions, article 2.11. This obligation applies to all investors regardless of account status. During the retention period, all data remains confidential and is shared only with AML/TF authorities upon an official request.
What data does Maclear store and for how long?
The 10-year minimum retention period covers all data categories collected and processed during your time on the platform:

The 10-year clock starts from the date of account closure, not from when each individual transaction or document was created.
What happens to your data when you close your Maclear account?
When you close your account, Maclear locks the account and stops processing your data for operational purposes. The data itself, however, is not deleted immediately. It enters a read-restricted retention state: it remains in Maclear's systems, it is not used for marketing or any active processing, and access is limited to compliance and legal functions only.
After the legally required retention period expires, your data is deleted in accordance with Maclear's Privacy Policy. No manual deletion request can override this timeline — the obligation is statutory, not a platform policy.
Can I request deletion of my data under GDPR?
GDPR grants the right to erasure, but this right is not absolute. Article 17(3)(b) of the GDPR explicitly recognises that the right to erasure can be overridden by a legal obligation, which is exactly the case here. Swiss AML legislation (AMLA) requires Maclear, as a regulated financial intermediary and member of PolyReg SRO, to retain identity and transaction records for at least 10 years. This obligation takes precedence.
In practice: a deletion request submitted before the retention period expires will be declined. Once 10 years have passed from account closure, data is deleted automatically and no further request is necessary.
Is my data shared with third parties during the retention period?
No. During the retention period, your data is not shared with third parties for any commercial or analytical purpose. It is disclosed only to AML/TF authorities upon receipt of an official request submitted to Maclear in accordance with Swiss law. Maclear does not share investor data with tax authorities or credit bureaus.
Can I reopen my account during the retention period?
Yes. Because your data is retained for 10 years, reactivating a closed account is possible within that window. To reopen your account, contact support@maclear.ch and provide a selfie with your identity document for re-verification.
